Alleged DUI driver causes on-the-job injury in construction zone

Workers in construction zones on California highways put their lives on the line every day. Not only are they exposed to the dangers posed by the equipment and construction vehicles on site, but also the negligence of drivers moving through the construction zone. A construction worker suffered a serious on-the-job injury when a suspected drunk driver recently knocked him down in Pismo Beach.

According to a police report, a 54-year-old woman was heading south on Highway 1 early on a recent Thursday morning. She struck a construction worker who was conducting traffic to get all vehicles safely through the construction zone. Witnesses said the impact threw the man approximately 15 feet.

Emergency workers rushed the injured accident victim to a hospital in a serious condition. Reportedly, the worker's injuries were not life-threatening, and he is expected to recover fully. Police arrested the driver on charges of felony drunk driving and took her to a county jail where she was booked before her release later.

Although this worker's injuries are not life threatening, hospital and doctors' bills can be substantial. While the victim can pursue recovery through the California workers' compensation insurance program, he can also seek to hold the driver accountable through a personal injury lawsuit. Whenever a third party who is not linked to the victim's employer causes an on-the-job injury, the victim may pursue a civil claim. However, compensation paid by the workers' comp may have to be paid back if monetary damages are recovered in a related civil claim.
